Appellee instituted this suit in the chancery court of White County against appellant to have the entire title to a “railroad forty” acre tract of land, and a two-thirds undivided interest in the James H. Joyce homestead of one hundred and fifty-one and sixty-one one-hundredths acres and the personal property situated on said land decreed to him.
