This suit was commenced by appellee against appellant before a justice of the peace, by summons in the usual form.

The amount of plaintiff’s demand, endorsed upon the summons by the justice, was $55.60, and on the trial before the justice the plaintiff was allowed to increase such amount to $155.60. An appeal being taken to the County Court of Wood-ford county, a judgment was there rendered in favor of the plaintiff for $164.80, and the defendant brings the record to this Court by appeal, and among others, assigns for error that the judgment exceeds the amount endorsed on the hack of the…
