delivered the opinion of the court.

This is a suit brought by Patrick Foley, appellee, against Frank D. Everett and George H. Campbell, appellants, to recover damages for injuries sustained by him from being struck by an iron shutter falling from an upper window of a building, which appellants were possessed of as trustees under a will. This is the second appeal of this case to this court. At the first trial there was a judgment for $10,000 in favor of appellee which was reversed by this court and the cause remanded. Everett v.
