—In an action to recover damages for personal injuries, etc., the defendant Incorporated Village of Valley Stream appeals from so much of an order of the Supreme Court, Nassau County (Burke, J.), dated November 10, 1994, as denied its cross motion for summary judgment dismissing the complaint and all cross claims insofar as they are asserted against it.
Ordered that the order is reversed insofar as appealed from, on the law, with costs, the cross motion is granted, and the complaint and all cross claims insofar as they are asserted against the Incorporated Village of Valley Stream are…
