This matter is before the court for a final decision concerning the disputed election of a Chapter 7 Trustee. On March 15, 2006, the debtor, TBR USA, Inc. (“TBR”), filed a petition for relief under Chapter 11 of the United States Bankruptcy Code. Subsequently, on November 3, 2006, the court granted TBR’s motion to convert this case from a case pending under Chapter 11 to a case under Chapter 7 of the United States Bankruptcy Code.
