Appeals and cross appeal from an order of the Supreme Court, *1339Erie County (Diane Y. Devlin, J.), entered February 1, 2008 in a personal injury action. The order, inter alia, granted the motion of plaintiff for partial summary judgment pursuant to Labor Law § 240 (1) against defendant Fisher Homes, LLC.
It is hereby ordered that the order so appealed from is unanimously modified on the law by denying the motion and by denying in its entirety the cross motion of defendant M.J. Ogiony Builders, Inc. and as modified the order is affirmed without costs.
