HALL, Chief Justice:
This is an appeal from a conviction of rape, a first degree felony. 1 On appeal, defendant claims that his trial counsel failed to investigate the availability of pro spective defense witnesses. He argues that this failure constitutes a denial of his constitutional right to effective assistance of counsel. 2 We reverse and remand for a new trial.
At trial, counsel for both the defense and the prosecution asserted that the only issue in contention was whether the victim in this case, Leslie Lavery, consented to sexual intercourse with the defendant Kenneth Templin.
