Clarence Brown appeals the sua sponte dismissal of his complaint, with prejudice and without notice and an opportunity to comment. We VACATE and REMAND.

I. Background

Clarence Brown was convicted in Texas state court of one count of aggravated assault on a peace officer and three counts of sexual assault, and was sentenced to fifteen years in prison. Before Brown was released from prison, the state initiated civil commitment proceedings against him under the Texas Sexually Violent Predator Act (“SVPA”), Tex.
