Appellant, H. T. Duncan, a resident of Lexington, Ky., suing for himself and all other citizens of the city of Lexington, instituted two suits in the Fayette circuit court‘against the appellees, T. A. Combs, etc., wherein he sought to hold them personally liable for certain sums of money amounting, in the aggregate, to about $60,000, which he alleged that they, as mayor, auditor, and members of the general council of the city of Lexington, had misappropriated and misapplied.
