This action, in substance, is one to quiet title to a parcel of land in dispute between the parties to this action. The essential and controlling facts are unquestioned.

The evidence shows that prior to January, 1867, one Marion Stewart was the. owner of a farm on the shore of Lake Erie, in the town of Hamburg, N. Y., commonly known as the “Morsman Farm.” Gen. Albert J. Myer entered into negotiations with her for the purchase of the northerly part of this farm, consisting of about 15 acres of land.
