Because I disagree with the Majority’s decision to discard Moreland, a sound and unanimous decision rendered by this Court less than four years ago, I dissent. I also believe the Majority misinterprets More-land.

Specifically, I challenge the Majority’s assertion that in Moreland this entire court “failed to consider the full text” of KRS 524.040(2)(a) and, consequently, was not aware that the current statute provides that one may be guilty of Intimidating a Participant in the Legal Process even when no legal proceeding was pending or imminent.8 I also reject the Majority’s assertion that in…
