Appeal from Shelby District Court. — HoN. O. D. Wheeler, Judge. Action to construe tbe will of Lars Weien, deceased. M. J. Larson, a son of tbe deceased, appeals from tbe decree of tbe trial court bolding tbat tbe widow took an estate in fee under the will.

(dissenting). — I sincerely regret the confusion which has for. some years existed in the decisions of this court on questions involving the construction of wills. The effect of the majority opinion is, in my judgment, to make that confusion “worse confounded,” and engender an infinite amount of hairsplitting in the future to preserve our record for judicial consistency. The right of every person, subject to statutory regulation, *664to dispose of his estate by will is one of the most valuable and most sacred known to the law.
