By this appeal the Citizens State Bank of Noblesville, Indiana, assails the judgment of the *209lower court quieting the title of the appellee to certain described lands. The facts alleged in the complaint of appellee are substantialy as follows: On January 8, 1883, John Glassar became the owner of the real estate in controversy, situated in Hamilton county, Indiana. On January 3, 1891, said Glassar, together with his wife, executed a mortgage on the land to W. H.
