Defendant Leon Ellsworth Griffes was convicted of having made an indecent exposure as a sexually delinquent person and sentenced to a prison term of from one day to life. The pertinent statutory provision is CLS 1961, § 750.335a (Stat Ann 1954 Bev § 28.567[1]) which states:

“Any person who shall knowingly make any opéii or indecent exposure of his or her person or of tfi.e person of another shall he guilty of a misdemeanor, punishable by imprisonment in the county jail for not more than 1 year, or by a fine of not more than $500.00, or if such person was at the time of said offense a sexually…
