Carter Estate

Pennsylvania Orphans' Court, Philadelphia County

Decided March 29, 1968No. 124Published

1Opinion of the Court

Shoyer, J.,

The death without issue of testator’s grandson, Alfred Y. Leaman, 3rd, on February 9,1966, poses questions as to distribution of future income as well as principal. Judge Saylor in his adjudication held that Alfred’s right to income ceased with his death. In disposing of the issue as to principal, which was presented to the court by petition for declaratory judgment and answer thereto, Judge *511Saylor also ruled that Alfred’s estate (or stirps) had no interest in the principal which was contingent on survival of Alfred (or his issue) until termination of the trust.
