This case is before this Court upon appeal of a final order of the Circuit Court of Lewis *321County entered on May 10, 2010. In that order, Arnold Wayne McCartney (hereinafter “the petitioner”) was sentenced to life imprisonment without mercy for his conviction of first degree murder, following a jury trial that began on February 16, 2010.
