The complaint contains a count for work and labor alleged to have been done and per*252formed by tbe Plaintiff for tbe Defendant, to tbe valne of Forty Dollars. Tbis count is on a quantum meruit. Tbe answer admits tbe labor, denies tbe .time of commencement, and avers that it was performed under a special contract by wbicb tbe Defendant was to pay for it in furnishing tbe Plaintiff a room in bis bouse and boarding ber and ber two children, and alleges performance.
