Glenn, appellee, the appellants, Hagen and Leslie, and Walter, not a party to the record, are brothers, the sons of L. A. and Lena Wellman. The mother, Lena, underwent an operation for cancer in April, 1924, and died October 28th following. On June 10th or 11th, after she returned from the hospital, she executed a bill of sale of her household furniture, and also a warranty deed to the family homestead, title to which was in her, conveying the same to Hagen and Walter.
