Appeal from special term, Albany county. Application by Rignal D. Woodward for writ of mandamus to Simon W. Bosendale, attorney general, commanding him to certify to the superintendent of insurance that the declaration and charter of the proposed sanitary insurance and inspection company of New York are in accordance with the requirements of law, as provided by Laws 1892, c. 690, art. 1, § 10. From an order granting a peremptory writ, (25 N. Y. Supp. 769,) defendant appeals.

The relator and 12 associates signed a certificate of their intention to organize an insurance incorporation, and presented it, with a proposed charter, also signed and verified by them, to the superintendent of insurance, who referred it for examination and certification to the defendant, as attorney general, *838pursuant to section 10 of chapter 725 of the Laws of 1893. The proposed certificate or declaration was in the following form:
