Silver, J.), entered August 23, 2006, which, insofar as appealed from, denied defendants’ motion to dismiss the complaint for failure to state a cause of action, and granted plaintiffs cross motion to amend the complaint to assert a claim based on General Business Law § 395-b, unanimously reversed, on the law, without costs, defendants’ motion granted, and plaintiffs cross motion denied.
