This is an appeal from the decree of the court below discharging rule for judgment for want of a sufficient affidavit of defense.

The plaintiff, on the 6th of June, 1929, entered judgement on a mortage bond and damages were assessed in the sum of $90,000.68. A fi. fa. was issued the same day and the real estate described in the mortgage was sold at sheriff’s sale to the plaintiff on a bid of $70,000.
