Proceeding pursuant to CPLR article 78 to review a determination of the respondent Board of Education of the Wantagh Union Free School District, dated June 3, 1997, which adopted the recommendation of a Hearing Officer, made after a hearing, that the petitioner was guilty of the disciplinary charges of misconduct concerning smoking on school grounds, which led to a fire, and terminated his employment.

Adjudged that the determination is confirmed and the proceeding is dismissed on the merits, with costs.
