h The defendant, Joseph Leath James, was convicted of theft, and that conviction was affirmed by this court in State v. James, 36,493 (La.App.2d Cir.12/11/02), 833 So.2d 1162. He was adjudicated a third felony offender and sentenced to four years imprisonment at hard labor without parole, probation, or suspension of sentence, to be served consecutively to any other sentence. This court amended the sentence by striking the provision denying the benefits of parole eligibility.
