MOREMEN, Judge.
This appeal is prosecuted from a judgment which upheld an award of the Workmen’s Compensation Board by which ap-pellee, Perry Burkhart, was granted compensation for total disability resulting from silicosis contracted while he was in the employ of appellant, Harlan Fuel Company. The question involves whether timely notice was given the employer.
