The nature and result and facts of this suit are. sufficiently given in the trial court’s conclusions of law and fact, which are as follows:

“(1) That on the 9th day of September, 1922, the Calumet Baking Powder Company, a foreign corporation, had a permit to do business in the state of Texas, and was engaged in selling baking powders to wholesale and retail dealers in such products in the state of Texas.
