In the court below, Charles L. Hall brought suit in claim and delivery against the Southern Pacific Company to recover the possession of thirty-one and one half tons of street-railway iron. The complaint alleged that Hall was the owner and entitled to the immediate possession of the railway iron, and that the same was wrongfully detained by the Southern Pacific Company from the plaintiff, Hall; that the actual value of the same was four hundred and fifty-five dollars; and that the said property had not been seized under any process, execution, or judgment against the property of Hall.
