Appeal from, Wvnneshieh District Court. Action at law upon an account for lumber sold. There was a verdict and judgment for plaintiff. Defendant appeals.

A motion to strike out the bill of exceptions, on tbe ground that it was not filed within the time prescribed by law, was submitted to us with the cause.

"We find that the facts, as to the date of the signing and filing of the bill of exceptions set out in the motion, appear in the abstracts before us. The verdict was rendered January 8, 1875, and defendant was allowed until the first day of June following to file his bill of exceptions.
