Plaintiff, respondent here, filed a suit seeking a divorce from his wife, who filed an answer admitting the marriage but denying the other allegations of the petition. She did not file a cross-bill. The trial court granted plaintiff a divorce and defendant appealed. The case reached the St. Louis Court of Appeals where the decree of the circuit court was reversed with directions to dismiss plaintiff's petition.
