Tbe appellant was found guilty, and sentenced to ten years’ imprisonment in tbe penitentiary, under an indictment charging bim with tbe murder of Thomas Walker. The evidence, in substance, was, that be was appointed specially by a justice of the peace to execute a search-warrant on tbe person or in the bouse of Walker, for the discovery of a coat alleged to have been stolen. Walker resisted tbe search, with threats of having his dead body to walk over before it should be done; but said be bad had such a coat as was described, and had returned it to the person from whom he procured it, because…
