On September 26, 1908, an attachment was issued in favor of Chapman against Yarn, on the ground that defendant was a fraudulent debtor. In the petition for attachment it was alleged that the defendant was a resident of Jeff Davis county. On the 30th day of the same month the attachment was levied on a described parcel of land situated in the county of Jeff Davis. The attachment was returnable to the February term, 1909, of the superior court of that county.
