*603In an action to recover damages for personal injuries, etc., the defendant ELRAC, Inc., appeals, as limited by its brief, from so much of an order of the Supreme Court, Suffolk County (Burke, J.), dated September 29, 2004, as denied that branch of its motion made jointly with the defendant Denise Argo, which was for summary judgment dismissing the complaint and the cross claim by Michael Diaz insofar as asserted against it.
Ordered that the order is affirmed insofar as appealed from, with costs.
