Seymour Ostrow, P.C., the plaintiff herein, moves, pursuant to Rule of Bankruptcy Procedure (“Bankruptcy Rule”) 7056 and Federal Rule of Civil Procedure (“FRCP”) 56 for summary judgment on the first of two causes of action asserted in an adversary proceeding commenced against the debtor, Joseph Balfour Schwartz.
