This is an action for personal injury, originally brought by Michael Devaney against the Otis Elevator Company. By an amendment the Standard Company and E. T. Harris were joined as defendants. In consideration of $375 the plaintiff gave the Otis Elevator Company a covenant not to further prosecute suit against that company. The suit thereafter proceeded against the Standard Company and E. T. Harris. The original declaration, consisting of one count, alleged that E. T.
