In a hybrid proceeding pursuant to CPLR article 78 to review a determination of the New York State Department of Environ*748mental Conservation dated November 19, 2007, adhering to its August 30, 2007, determination to terminate the petitioners’ Brownfield Site Cleanup Agreement dated October 14, 2004, and action, inter alia, for declaratory relief, the petitioners/ plaintiffs appeal from an order and judgment (one paper) of the Supreme Court, Queens County (Kitzes, J.), entered August 12, 2009, which, among other things, denied the petition and dismissed the proceeding.
