This is an appeal from an order denying a motion to vacate a default judgment. The action is one to recover damages for personal injuries alleged to have been caused by the negligence of the defendant Patzer in the operation of his automobile in which the plaintiff was riding as a guest. Patzer held a policy of insurance with the Indemnity Insurance Company of North America protecting him against loss in the circumstances set forth in the complaint.
