Mabel Evatt, by her father as next friend, sued the City of Chattanooga for damages for personal injuries sustained from the alleged negligence of the city in allowing a precipice, or pitfall, to remain unbarricaded where an alleged public street terminated at the right of way of the Cincinnati, New Orleans, and Texas Pacific Railway. On the night of July 6, 1929, she was seriously injured when the automobile in which she was riding as a guest was driven over the embankment and upon the railway track and cross-ties.
