The plaintiff in error was, in October, 1870, in the oyer and terminer of Wayne county, convicted of the willful murder of one Samuel Olts, alleged to have been committed in January, 1870, and sentenced by the court to be hanged, on the 14th day of January, 1871. He sued out a writ of error, commanding the court of oyer and terminer to return the record and proceedings into this court. And thereupon an order staying proceedings on the judgment was made by the justice of the Supreme Court, who presided on the trial. The clerk of Wayne county returned to the said writ…
