WILDER, J.
One Lavinia Kapu (w.) having died intestate, an administrator of her estate was appointed, and one of the claims presented to him and not rejected was for $3464.05, which wa.s secured by a mortgage on real estate. This claim with the security was assigned to' the Waialu'a Agricultural Co., Ltd., which company, before any of the debts of the decedent were paid, foreclosed on its security ‘realizing therefrom $3000, leaving a balance due of $464.05.
