In this equity case plaintiff was represented by defendant real estate agency in the sale of her home. Defendant agency secured a buyer and a standard agreement of sale was executed including the requirement that plaintiff/seller must pay two points mortgage placement fee. However, the closing on the sale was delayed for one week beyond the agreement of sale closing date during which interim the mortgage placement fee required of plaintiff/seller jumped to six points.
