James Winberry’s dependents (hereinafter, and collectively, “Appellant”) petitioned the Labor and Industrial Relations Commission (hereinafter, “the Commission”), requesting all future permanent total disability (hereinafter, “PTD”) payments of James Winberry (hereinafter, and individually, “Winberry”) be paid to them pursuant to Schoemehl v. Treasurer of the State of Missouri, 217 S.W.3d 900 (Mo. banc 2007). The Commission entered its order stating it had no statutory authority to order the continuation of payments to Appellant.
