This is an action in which the treasurer of Hamilton county seeks to subject the rents and other income from certain real estate to the payment of delinquent taxes assessed against such real estate. The action was filed under favor of Section 5703, General Code, which provides that a county treasurer may institute an action to have himself ex officio appointed receiver to collect and apply the rents, issues, and income to the payment of the delinquent taxes on such real estate. The trial court found in favor of the defendants and this appeal is from that judgment.
