Defendant in error, hereinafter referred to as plaintiff, commenced this action against plaintiff in error, hereinafter referred to as defendant, fo recover an alleged balance due "plaintiff for the purchase of a half interest in a stock of merchandise.

Plaintiff alleged that about January 1, 1931, plaintiff and defendant entered into a partnership, and as such partners operated a clothing store in Watonga, Okla., until about January 1, 1934, at which time the partnership was dis solved.
