Respondent Bobbie G. Hardee, Jr. applied on behalf of respondent Port Oil Company, Inc. to appellant South Carolina Alcoholic Beverage Control Commission for a permit to sell beer and wine for off-premise consumption. The Commission denied the application, concluding that the Port Oil location was not a proper one. Port Oil appealed to the Circuit Court which reversed the Commission’s decision ordering it to issue the permit. The Commission appealed to the Supreme Court.
