*256In an action for a judgment declaring a deed null and void, the defendant appeals from an order of the Supreme Court, Putnam County (Hickman, J.), dated May 5, 2003, which granted the plaintiffs motion for summary judgment.

Ordered that the order is affirmed, with costs, and the matter is remitted to the Supreme Court, Putnam County, for the entry of a judgment declaring that the subject deed is null and void.
