Appeal from a judgment (denominated order) of the Supreme Court, Cayuga County (Peter E. Corning, A.J.), entered October 16, 2003. The judgment, inter alia, denied defendants’ motion to vacate a default judgment.

It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously reversed on the law without costs, defendants’ motion is granted in part, the judgment entered March 13, 2002 is vacated, plaintiffs are directed to accept service of the answer dated January 28, 2002 and the claim for partition is dismissed, and the motion to confirm the Referee’s report and…
