Appeal from Shelby District Court. — IIon. W. R. Green, Judge. Action upon a policy of fire insurance covering a stock of merchandise and store fixtures. There was a jury trial, resulting in a verdict and judgment for plaintiff, and defendant appeals.-

1 *4912 *487Defendant is a mutual company, «organized under .section 1160, Code 1873, with its amendments, and tbe principal question discussed is whether it is subject to the requirements of section 1741, chapter 4, title 9, Code 1897.
