In two negligence actions to recover damages for personal injuries, the defendants John DeSimone, Jr. and Rinaldi Car and Truck Rentals appeal from an order of the Supreme Court, Rockland County (Weiner, J.), dated December 14, 1987, which denied their motion for leave to amend their answers to assert the defenses of res judicata and/or collateral estoppel and for summary judgment dismissing the plaintiffs’ complaints based upon those defenses.

Ordered that the order is affirmed, with costs to the plaintiff-respondent Levett.
