On or about December 16, 1987, plaintiff Donegal Mutual Insurance Company commenced a declaratory-judgment action Seeking, inter alia, a decree that defendant Progressive Casualty Insurance Company is obliged to assume the defense of or provide insurance coverage to defendant Deborah Hart. An answer with new matter was filed by Progressive on or about June 23, 1988. Plaintiff filed a reply to the new matter.
