Huckabee and wife,, appellees, sued the appellant railway company for damages occasioned by the death of their son, J. W. Huckabee, through the alleged negligence of the appellant in failing to keep and maintain its road crossing on Virginia street, in the town of Floyd City,, in good condition, and in permitting its ties and rails to rise above the level of the. roadway some four or five inches, and negligently allowing the track so to remain.
