McCord, Judge.

Under the provisions of Article 175, White’s Code of Criminal Procedure, relator sued out a writ of habeas corpus before the Judge of the Criminal District Court of Dallas County, Texas, and in his petition he alleged that he was in legal custody and confined in the county jail of Dallas County under an indictment for murder and that “he is afflicted with a disease which renders his removal necessary for the preservation of his life and that any species of confinement will endanger his life.” The writ was granted and on September 29th the Criminal District Court of Dallas…
